22 June 2017Further decision in the matter of taxi vs UBER: lead by Dieter Heine, the Vavrovsky Heine Marth Controversy-team obtained another positive decision for the Austrian taxi industry. The Commercial Court Vienna issued another injunction against a rental car company whose drivers accept fares via UBER. The court found that the rental company could not show that the bookings of the fares are made via the company instead of directly with the driver. In addition, the court found that the UBER-partner violates the legal obligation to return to the permanent business location after each fare.
13 June 2017Prevention of money laundering and terrorist financing: Daniel Azem gives internal training. On January 1, 2017, several new regulations, which had to be implemented into Austrian law due to the 4th EU-Anti Money Laundering Directive, went into force. In the course of an internal Training for the Vavrovsky Heine Marth team, Senior Associate Daniel Azem spoke about the new regulations applicable to the legal Profession. The new rules on legal dilligence aim to prevent money laundering and terrorist financing.
12 June 2017Taxi vs UBER: Dieter Heine obtains injunction for two taxi companies. Under the lead of Dieter Heine, Vavrovsky Heine Marth repressents two taxi companies suing a Vienna based rental car company driving for UBER. Following the plaintiffs, the Vienna Commercial Court found that the rental car company was distorting competition and issued an injunction. According to the injunction bookings for fares may not be made directly to the driver's app, rental cars have to return to their permanent business location after finishing their fare. Several Austrian media reported on this groundbreaking decision.
